Newsletter terms and conditions
Definitions
- Newsletter Service Form – a form available on the Website, filling in of which by the Customer shall enable him/her to use the Newsletter Service;
- Galeria Katowicka – shopping centre located in Katowice (address: ul. 3 Maja 30, 40-097 Katowice);
- Privacy Policy – annex no. 1 to the Regulations;
- Regulations – this document, which sets out the rules for the use of the Website and for the provision of Services;
- Website – the website belonging to the Service Provider, available at galeriakatowicka.eu;
- Newsletter Service – the service consisting of sending the newsletter of Galeria Katowicka free of charge;
- Services – services provided electronically by the Service Provider to Customers under the Terms and Conditions; in particular the Newsletter Service;
- Customer – a natural person, a legal person or an organisational unit without legal personality using the Website and/or Services;
- Service Provider – Estlin Investments sp. z o.o. with its registered office in Warsaw (address: ul. Towarowa 28, 00-839 Warszawa), entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS number: 0000636799.
General provisions
- The Regulations set out:
- the rules of using the Website;
- the manner in which the Services are provided by the Service Provider;
- rules of using the Services by the Customers.
- The use of the Website and/or the Services by the Customer is subject to the terms and conditions set out in the Regulations.
- The Services are provided by the Service Provider in accordance with the Regulations. If the provision of any of the Services requires the Customer to accept additional or amended provisions of the Regulations, the Service Provider will inform the Customer about these changes before the start of the use of a particular Service.
- The Regulations and information on amendments to the Regulations are available to the Customer free of charge on the Website in a form which enables downloading, recording and printing. The Customer is bound by the provisions of the Regulations made available in the manner described above.
- The Customer is obliged to read the Regulations before using the Website and/or Services and is obliged to comply with the provisions of the Regulations.
- By starting to use the Website and/or the Services, you accept the Regulations.
Scope of Services
- The Service Provider shall provide Services to the Customer. In particular, the Service Provider shall provide the Newsletter Service to the Customer.
- The Newsletter Service is provided under the Regulations.
- The Service Provider may provide other Services. In the case of providing other Services, the Service Provider shall in each case present to the Customer the conditions for the provision of a given Service.
Newsletter service
- As part of the Newsletter Service, the Service Provider shall send, by electronic mail to the e-mail address provided by the Customer, a newsletter which contains, in particular, information on current special offers in Galeria Katowicka, information on the opening of new shops in Galeria Katowicka, events in Galeria Katowicka and other news related to Galeria Katowicka.
- The Newsletter Service is provided free of charge for an indefinite period of time.
- The newsletter is sent no more than every 7 days.
- Each newsletter contains:
- sender information;
- defining the subject of the newsletter;
- information on how to unsubscribe from the Newsletter Service.
- The Newsletter Service is ordered by:
- filling in the Newsletter Service Form on the Website;
- acceptance of the Regulations;
- consent to processing of the data provided in the Newsletter Service Form for the purpose of Newsletter Service execution;
- click on the “sign up” button.
- Providing the Customer’s email address in the Newsletter Service Form is necessary, in order to provide the Newsletter Service.
Conditions for providing the Services
- The Service Provider reserves the right to modify the Services or the way the Website operates. If the modification is related to the necessity of amending the Regulations, the Customer will be informed of the change in the manner provided for in the Regulations.
- The Service Provider reserves the right to refuse or discontinue the provision of Services if the Customer violates the provisions of the Regulations.
Conditions of using the Services
- It is forbidden to use the Website and/or Services in a manner that is unlawful, violates the provisions of the Regulations or the legitimate interests of the Service Provider.
- It is forbidden to carry out actions that may hinder or prevent the functioning of the Website and/or Services.
- The Service Provider reserves that all materials available on the Website and/or in the Services, including in particular graphics, articles and photos are protected by copyright.
- The access to the Website and Services is available to the Customers:
- having a connection to the public Internet network;
- having a web browser capable of displaying HTML documents on the computer screen with the option of accepting cookies.
Conclusion of the agreement
- Conclusion of the Newsletter Service agreement shall take place with correct filling in of the Newsletter Service Form.
Provider’s rights and obligations
- The Service Provider undertakes to provide the Services to the Customer.
- The Service Provider shall make every effort to ensure that the Website operates in a continuous manner. The Service Provider reserves the right to interrupt the operation of the Website or the provision of Services in order to update data, correct errors and perform other maintenance work. The Service Provider shall not give prior notice of any planned interruption in the operation of the Website and/or in the provision of Services.
Protection of personal data
- The administrator of the Customers’ personal data processed in connection with the use of the Website and/or in connection with the provision of the Services is the Service Provider.
- The Service Provider processes the Customer’s personal data necessary for the establishment, shaping of the content, modification or termination of the contract for the provision of services by the Service Provider and solely for the purpose of proper implementation of the Services, in accordance with the Regulations and the Act of 18 July 2002 on provision of services by electronic means (i.e. Journal of Laws of 2017, item 1219). The Service Provider processes the Customer’s personal data in accordance with the provisions of the Personal Data Protection Act of 29 August 1997 (i.e. Journal of Laws of 2016, item 922).
- When making the Newsletter Service Form available, the Newsletter Service Provider shall specify data which is necessary to enter into a contract for provision of the Newsletter Service. Providing personal data is voluntary. Refusal to provide personal data may result in the impossibility of Newsletter Service provision by the Service Provider.
- By filling in the Newsletter Service Form, the Customer agrees to the processing of personal data concerning him/her.
- The Service Provider, as the data administrator, cares about the security of the personal data provided by the Customers and applies the measures required by law to ensure the security of such data.
- The Customer has the right to access, complete, update or correct his/her personal data, as well as to request the cessation of its processing, in which case the Customer accepts that the cessation of data processing may entail the cessation of the provision of Services.
Termination of the agreement
- The Service agreement may be terminated by either Party.
- The Newsletter Service agreement may be terminated by the Customer by sending the information about resignation from the Newsletter Service to the email address: www@galeriakatowicka.eu or by clicking on the Newsletter Service agreement termination link placed under the Newsletter.
Complaints procedure
- The Customer has the right to lodge a complaint in connection with the use of the Website and the performance of the Services.
- Complaints are dealt with by the Service Provider.
- The Customer may submit complaints by means of:
- contact form on the Website;

- e-mail – address: www@galeriakatowicka.eu
- The complaint should contain the name, surname and the e-mail or postal address (depending on the method of submitting the complaint), the subject of the complaint and information substantiating the complaint.
- The Service Provider shall consider the complaint within 14 days of receiving the complaint.
- A complaint shall be considered on the basis of the provisions of these Regulations.
- The Service Provider shall inform the Customer of the decision in the same form in which the complaint was received.
- A complaint considered by the Service Provider in accordance with the provisions of the Regulations shall not be reconsidered.

Final provisions
- The Service Provider has the right to amend the Regulations. Information about amendments to the Regulations shall be sent to the email address indicated in the Newsletter Service Form. Information about amendments to the Regulations shall be sent no later than 14 calendar days before the amended Regulations become effective.
- Information about the date on which a given version of the Regulations is in force is placed at the beginning of the Regulations. Changes to the Regulations shall become effective on the date specified in the information sent to the Customer about the change, but not earlier than 14 calendar days after the notification of changes to the Regulations. The amended Regulations will be binding on the Customer if, within 14 calendar days of the date on which the Customer was informed about the change of the Regulations, the Customer does not inform the Service Provider about the withdrawal from the Services.
- In matters not covered by these Regulations, the relevant provisions of the Civil Code, the Personal Data Protection Act and the Act on Provision of Electronic Services shall apply.
